I’ve read the Google rant, the Brad Smith response tweet and now this entire article. It seems pretty clear that someone needs to build a list of actual patents being violated.

Brad Smith’s tweet is delightfully void of substance. Sure Google helped bid on patents to help protect itself, but the valuation got obscenely high… daringfireball seems to miss the point of an auction. If a normal foreclose goes for 25k, you very well might bid up to 75k on it if the market value might sustain it, but at some point you have to cut your losses and get out of the bidding.

It really doesn’t matter who owns the patents, what matters is if they are meaningful. It appears that all companies are acting in their best interest. The patent owners and the defendants. The true question is: should these patents have been granted in the first place?

Given how patents are used now (constant lawsuits and counter lawsuits), it really is a waste. It’s also a waste due to the simplicity of some patents. I used to think that patents were worthwhile as they protected the inventor, but the truth be told — it really isn’t working any more. Maybe it’s the time frame of the patents (15-20 years from date of completion, not filling).. Maybe it’s simple that I see computer/software patents more than anything.. I am not sure..

The one thing I do know, is that it isn’t working.
